We are mostly controllers of data, not processors. As controllers we decide the purpose for collecting the personal data and how it will be processed.
During the conduct of your case any information that you provide to us or that we obtain on your behalf will only be disclosed to staff and/ or third parties instructed on your behalf with your knowledge. Therefore, unless you specifically tell us otherwise, we will not give any information to anyone else about your case except data that we are required by our criminal contract to disclose to the Legal Aid Agency or to comply with our professional bodies, the Solicitors Regulation Authority or the Law Society.
We will only request of you and obtain on your behalf such information as is necessary to properly assist you or we are required to obtain by our professional bodies and this information will be kept securely.
Special category data includes data revealing race or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and genetic data, biometric data, data concerning health or data concerning a person’s sex life or sexual orientation.
We will not generally obtain your specific consent for obtaining and processing this data but rely on the contract between us or with our professional bodies or legitimate interests.

If you ask to see the data we hold about you, it is known as a ‘subject access request’ (SAR)’. We must give you a copy of your data within one month. Please put the request in writing to Liam Muir, who is the person responsible for data protection at Carter Osborne Limited.
We have an overriding duty of client confidentiality but we can work closely with other agencies and organisations to try to ensure that our clients have access to all of the services they need.
